STUDENT ENROLLMENT CONTRACT
This Agreement establishes the relationship between Miami ML Music (referred to as “the Academy”) and the student or parent (referred to as “the client”). Client and Academy shall collectively be referred to as the “Parties.”
Miami ML Music provides online music classes;
Tuition: The Academy offers music classes for a monthly fee, with tuition billed automatically each month.
Registration Fee: The client agrees to pay the Academy a yearly recurring Registration Fee on the Effective Date of this Agreement, and subsequently, every year thereafter, unless this Agreement is terminated. The fee is subject to periodic increases.
Video/Audio Tape Consent. The client understands and agrees that the Academy records classes to maintain a safe environment, enforce policies, resolve issues, and address incidents. By giving consent, the client allows the Academy to use and share the audio and/or video recordings, while releasing the Academy from any liability associated with their use.
Photos and Images. Client consents the academy to use Student’s name, photograph, voice, images and videos for promotional purposes without compensation or notice. Client releases Academy from any liability.
Addressing Issues. The Academy welcomes clients to report issues or mistakes, but may ask parents and students to no longer participate in the classes if angry or foul language is used. No refunds will be made if such dismissal occurs.
The Academy reserves the right to withdraw an offer of enrollment or re-enrollment at any time and to void an executed Enrollment Contract.
Term and Termination. The Parties agree that this Agreement is for a monthly term and is automatically renewed unless terminated by either party before the monthly payment due date. The client must provide written notice of withdrawal to terminate the agreement for the following month. The Academy reserves the right to immediately terminate the agreement in case of any violation of its values.
Acknowledgment of Withdrawal: To discontinue lessons and to discontinue charges to your account, fill out the withdrawal form before your due date.
Students will be responsible for their last month’s tuition whether or not they attend lessons. No refunds are given for students missing their last month.
Governing Law/Waiver of Jury Trial. The Agreement is governed by Florida’s laws, without conflict of law principles. Parties waive jury trial rights for claims related to Student’s enrollment, attendance, or separation from the Academy. The exclusive venue is the Southern District of Florida or Miami-Dade County court.
Entire Agreement. This Agreement outlines the Parties’ complete understanding of the subject matter. The waiver of any right or obligation herein must be made via written amendment signed by all Parties.
Waiver of Trial by Jury. Both parties involved in the agreement acknowledge the likelihood of complex issues arising and mutually agree to waive their right to a trial by jury for any legal action related to the agreement or its attachments
IN WITNESS WHEREOF, the Parties hereto have executed this Agreement on the Effective Date of the student’s enrollment.
